PLEASE READ CAREFULLY THIS IS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS
In consideration of and as a condition to entering The Hive Community Center. (DBA: The Hive Community Center LLC, Parent Corporation Parker PCH Inc., referred to herein as “HCC”) allowing Participant (as defined below) to participate in any activities offered through HCC’s activity offerings (collectively referred to as the “Activities”), and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Participant hereby agrees as follows.
1. “PARTICIPANT” MEANS AN INDIVIDUAL PARTICIPATING IN ANY ASPECT OF THE ACTIVITIES (INCLUDING SUPERVISION OF A PARTICIPANT UNDER THE AGE OF 13). THE PARTICIPANT MAKES THE REPRESENTATIONS AND AGREEMENTS SET FORTH BELOW IN THIS PARTICIPANT ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT (THIS “RELEASE”).
2. ANY PARTICIPANT UNDER THE AGE OF 18 REQUIRES THE SIGNATURE OF A PARENT OR CAREGIVER ON THIS RELEASE FORM. PARENTS AND CAREGIVERS ASSUME ALL RESPONSIBILITIES AND OBLIGATIONS OF THIS RELEASE ON BEHALF OF THE UNDER-18 PARTICIPANT AND ARE THEMSELVES CONSIDERED “PARTICIPANTS” FOR THE PURPOSES OF THIS RELEASE.
3. ANY CHILD PARTICIPANT UNDER THE AGE OF 13 MUST BE ACCOMPANIED BY A PARENT OR CAREGIVER. ACCOMPANYING PARENTS AND CAREGIVERS MUST STAY WITH CHILDREN AT ALL TIMES AND KEEP THEM IN SIGHT. PARENTS OR CAREGIVERS ARE RESPONSIBLE FOR THE SUPERVISION, CARE, COMPLIANCE, AND SAFE PARTICIPATION OF THEIR UNDER 13 CHILD IN ANY ACTIVITIES.
4. THE PARTICIPANT UNDERSTANDS THE NATURE OF THE ACTIVITIES AND VOLUNTARILY ASSUMES ALL RISKS ASSOCIATED WITH THE ACTIVITIES. The Activities are potentially dangerous and include but are not limited to: using machinery within a “Maker’s Space” in the HCC such as a heat press, 3D printer, sewing machines, embroidery machines, cricket machines, engraving machines; working with any materials which may be sharp, extremely hot, or irritating such as plastics, sharp tools and needles, polymers, ink, metal, and others; using interactive sport equipment and physically participating in sports simulation such as swinging a golf club or throwing a ball at a sports simulation screen; using electronic equipment for the creation of materials-based projects, audio recording, video recording, and others; and/or other Activities that the Participant or other Participants choose to participate in within the HCC. The Participant understands that participation in the Activities involves risks of serious bodily injury, illness, death, economic loss or property damage, including permanent disability, paralysis, and death, and which the Participant’s own actions, inactions, or negligence; the actions, inactions, or negligence, of others participating in the Activities (directly or indirectly); the places and conditions in which the Activities take place; and/ or the negligence of any Released Party (as defined below) may cause.
